As of Monday 31st May, new reforms to the personal injury system came into place which Robert Buckland QC has described as the end of ‘greedy opportunism’.

The reforms mean that costs for claims under £5000 are no longer recoverable. Further changes include set tariffs being imposed for road traffic accidents occurring from 31st May 2021. The knock on effect being claimants receiving considerably less compensation then they had previously.

These reform have been in transit since 2015 and will make it significantly more difficult to make a claim for whiplash which Buckland has described as being abused by ‘ individuals looking for an easy payday’.

There will also be an effect on solicitor firm as there will need to be a consideration of the costs element if they are no longer recoverable in smaller claims under £5000.
