To apply for a divorce or dissolution, you must have been married or in the partnership for at least one year.  Your marriage or partnership must also be legally recognised in the UK.  You must also live permanently in England or Wales.

The process of ending a legal relationship, be that divorce, if you are married, or dissolution, if you are in a civil partnership, is largely administrative but can be complex.  An application form is submitted to the court containing a formal declaration that the marriage or civil partnership has broken down.  You do not have to give a reason for the breakdown.  The application can be made by either of the parties to the marriage or partnership.  It can even be made together if you remain on good terms with your estranged partner.

The process of divorce and civil partnership dissolution takes a minimum of twenty-six weeks.  Twenty weeks after your application is issued you can apply for a conditional order.   The issue of a conditional order is the first stage in your divorce or civil partnership dissolution and signifies that the court has decided that there is reason why your divorce or civil partnership cannot proceed.  Six weeks later you can apply for a final order.  Once the final order has been issued your marriage or civil partnership is ended.
